Police say that at 5:43 p.m., Zavala was walking south on the shoulder of the road when he stepped into the path of a car being driven by Donald Bailey, 71, of Gap. Zavala was wearing dark clothing and Bailey told police he had no time to brake. A motorist who saw the incident confirmed that Zavala staggered into the path of Bailey's car.
