Kennett Township sued for McCarthy crash

Paula A. Sharpe and her husband, George A. Pigford, have filed a personal injury lawsuit against Kennett Township and its police chief, Albert McCarthy, for the Oct. 4, 2011 ramming of his patrol car into Sharpe's vehicle on Creek Road, after which McCarthy left the scene.

This incident resulted in McCarthy's six-month suspension and loss of his driver's license when it was discovered that he was on drugs for epilepsy.

The lawsuit filed by local attorney George S. Ponze on Sept. 4 alleges serious personal injuries -- Sharpe for acute post-traumatic lumbar spine sprain and other related medical problems, as well as future loss of income. Her husband is alleging loss of consortium as a result of his wife's medical problems.

The lawsuit contends negligence and carelessness led to the rear-end collision while McCarthy was on medication for an epileptic condition and driving a Kennett Township patrol car. Both Sharpe and Pigford are asking for more than $50,000.

The Chester County Press has learned that the lawsuit was filed after settlement talks failed.
