Driver arrested for DUI and firing unlicensed gun

New Garden Police arrested a Wilmington man for firing a handgun out of his truck window on March 15.

According to a police report, an officer in the 1400 block of Baltimore Pike in Toughkenamon heard four shots from a nearby residential area at 2:20 a.m. He saw a black Chevy Avalanche leaving the area, and stopped the truck at Church and Center streets. The driver, Jose Pizano-Ortiz, 30, of Wilmington, Del., showed signs of intoxication. On the front seat were spent .40 caliber shell casings, and a semiautomatic handgun was wedged between the front passenger seat and the center console. An open bottle of liquor was in the console.

The gun's 12-round magazine was found to be empty. The gun was unregistered and Pizano-Ortiz does not have a permit to carry a firearm. He was arraigned on charges of DUI, carrying a firearm without a license, and recklessly endangering another person. He was taken to Chester County Prison after failing to pay $35,000 cash bail. The report did not indicate why Pizano-Ortiz was firing the gun.
